PURCHASE CONDITIONS

General

These terms and conditions apply to all sales of goods from this online store to consumers and online store sales. The customer's order confirmation/order, together with these terms and conditions, constitute the entire agreement for the transaction. The terms and conditions are numbered consecutively in the event of changes. We will store information about which version of the terms and conditions of sale applies to your order.

 

These terms and conditions apply only to sales in Norway, including Svalbard and Jan Mayen. Any shipping costs to the latter must be paid by email after the order has been registered. Customers outside this area must contact us by letter or email.

 

Sales to consumers are regulated by, among other things, the Consumer Purchases Act and the Right of Withdrawal Act.

 

Parties

The seller is: flaggbutikk.no, flaggbelysning.no, billignavnevimpel.no, bordflagget.no, campingflagg.no, signalflagg.no (Van Kaam Handel AS)

 

Legal address: Gjerstadveien 1488, 4980 Gjerstad, Norway, with organization number 914141893, hereinafter referred to as “we” or “us.”

 

The buyer is: the person specified as the buyer in the order, and is hereinafter referred to as “you”, ‘your’ or “yours”.

 

Postal address: Van Kaam Group BV, Brugweg 27, 2741KT Waddinxveen, Netherlands.

 

Payment methods

Invoice for all creditworthy customers: we offer invoice payment with a due date of 7 working days after the order, the invoice is attached to the email.

 

Invoices are in NOK.

 

A simple credit check is performed upon invoice payment. Unless otherwise agreed, all invoices must be paid in advance before shipment of goods. After the due date, statutory interest on late payment will be charged.

 

Payment cards Stripe/Visa and MasterCard. All information is treated confidentially.

 

Payments other than Stripe are paid by invoice. The invoice fee is NOK 50 excluding VAT, NOK 62.50 including VAT.

 

After payment, we will produce/deliver your product(s) within 5-15 working days, or as otherwise specified.

 

The amount can also be transferred to account number 1503.64.47173 (Van Kaam Handel AS)

 

After 14 days Reminder (+ NOK 65 + 8.5%)

After 20 days 1st collection (+ NOK 150)

Invoices that are not paid within 30 days will be sent to an external collection agency.

 

The customer is responsible for these additional costs.

 

Orders

All orders are considered binding. If an order is canceled before it has been shipped for delivery, 50% of the invoice value will be credited.

 

Prices

All prices include 25% VAT (when paying with Stripe, Klarna, Vipps, Paypal, and invoice in NOK). We reserve the right to change prices due to changes in exchange rates, changes in statutory fees or significant price changes from our suppliers. We also reserve the right to correct any printing errors in prices. Online discounts only apply to purchases made in the online store. If you would like an invoice, the regular prices apply.

 

Delivery and delays

Ordered goods are shipped with UPS from the Netherlands (warehouse) Posten (regular mail) / UPS (express) and the price is from NOK 99 excl. VAT (NOK 123.75 incl. VAT). Van Kaam Handel AS pays the remaining part of the actual cost of shipping the package. We bear the risk for the products until they are taken over by you, i.e. when you have received the products in your possession.

 

Products that we have in stock (in the Netherlands) will be delivered within 5-10 working days after we have received payment. Products (Norwegian products) that we have in stock (in Norway) will be shipped from Høland flagg / Larvik flaggfabrikk. We stock all the products you can see in our online store. Exceptions are items that are not in stock. There may be deviations from this provision, but this will always be communicated via email.

 

Delivery time, shipping, and customs

We strive to deliver as complete an order as possible to keep costs down for you. It will take 5-15 business days, depending on where you live in the country, from the time you pay until you receive the goods. Exceptions are items that are not in stock or items that must be ordered (10-15 business days).

Payment of import costs is possible. We keep stock in the Netherlands for all 197 country flags in the following sizes: (10x15cm, 20x30cm, 30x45cm, 50x75cm, 70x100cm, 100x150cm, 150x225cm and 200x300cm and all productions (logo). Flags / pennants) all other sizes come from stock in Norway.

If you still receive an invoice for import costs, do not pay this invoice and send the invoice to flaggbutikk@vkhn.no stating: import costs customs

We will then pay the invoice for you within two working days.

Terms of payment

The goods are shipped with Stripe/invoice or against advance payment by agreement. Credit sales can be agreed subject to a credit check.

 

Damage during transport

We take responsibility for ensuring that the goods arrive in good condition. If the packaging is damaged, you must check

the contents of the shipment before accepting delivery. Then make a note on the delivery note or on the Post Office form and

report the damage to us. We will send you new goods free of charge and arrange further follow-up with the Post Office or the carrier.

 

Cancellation

You always have a 14-day cancellation period for mail order purchases. The buyer must cover the return postage and will receive a full refund for

returned goods. This assumes that the goods are returned in good condition and in their original packaging. Custom-made and/or specially ordered goods cannot be returned under any circumstances. Please provide your account number and you will be refunded immediately. You can return an item without giving a reason, but we would appreciate it if you could describe the reason for the return on the return form. If you exercise your right of withdrawal and return the item(s) by post or letter, you will be responsible for the return shipping costs. You are responsible for the transport risk. Once we have received the item(s) back in undamaged condition, we will refund the amount you have paid within 30 days.

 

Packages that are not collected

If you choose not to collect your package, you must notify us and pay the return postage. Packages that

are returned uncollected without notification will incur costs in the form of postage and a return fee. Fee: $250

 

Force majeure

Should a situation arise that makes it impossible for us to fulfill our obligations under this agreement, and which according to normal purchase law rules is considered Force Majeure, the affected party's obligations shall cease for as long as the extraordinary situation persists.

 

Force majeure includes, for example, changes in legislation, labor disputes, strikes, lockouts, or other circumstances beyond the control of the parties, such as war, riots, fire, explosion, or intervention by public authorities. The same applies to sudden changes in product labeling requirements, warning texts, sales bans or decisions by authorities that adversely affect the market and products, or an abnormal decline in the market.

 

Minimum age

To shop in our online store, you must be at least 18 years old. If you are under 18, you can have an adult,

e.g. a parent or guardian, shop for you.

 

Complaints (errors, damage, and defects)

Notifications of errors, damage, and defects in products can be sent to us in writing.

This must be done within a reasonable time after you have discovered the defect, damage or deficiency. However, you always have at least two weeks to make a complaint. We will confirm receipt of all complaints in writing. We will also confirm receipt of any goods returned to us in writing.

 

Disputes

The parties shall attempt to resolve any disputes amicably. If this is not successful, you can bring the matter to the Consumer Council near where you live. All disputes shall be settled in accordance with Norwegian law. If the case is brought before the courts, it shall be decided in your (the buyer's) jurisdiction, which is normally near where you live.
